We want to share an important update regarding the lawsuit challenging New Mexico’s affordable spay/neuter law.
Last week, the First Judicial District Court granted partial summary judgment in favor of the plaintiffs (the Pet Food Institute and its corporate allies) challenging Senate Bill 57. We respect the Court, but we respectfully disagree with the Court’s decision and are evaluating our options, up to and including an appeal.
This ruling is deeply disappointing for the many communities, animal shelters, veterinarians, and families who rely on affordable spay/neuter services funded through this law.
Since its passage in 2020, New Mexico’s affordable spay/neuter program has generated more than $1.3 million annually to help reduce euthanasia, prevent unwanted litters, and expand access to veterinary care in underserved communities across the state.
Animal Protection Voters intervened in this case because we believe this law represents a humane, effective, and fiscally responsible solution to pet overpopulation. We continue to believe strongly in both the legality and importance of this funding mechanism.
While today’s ruling is a setback, it does not change the urgent need for affordable spay/neuter services in New Mexico. We will share additional updates as we evaluate next steps.
